Equipment Hire Agreement, Terms & Liability Waiver Important

Please read this document carefully before completing your booking and payment. By proceeding with payment, you acknowledge that you have read, understood, and agreed to all terms, conditions, and waivers set out below.

1. Assumption of Risk & Personal Responsibility

I, the Hirer, understand and fully acknowledge that hiring and using surf equipment (including but not limited to surfboards, bodyboards, wetsuits, leashes, paddleboards and accessories) comes with inherent risks. These include, but are not limited to:

Injury from falling, collision with other surfers, swimmers, objects, or the seabed.
Drowning, strong currents, rip currents, and hazardous water conditions.
Adverse weather conditions such as high winds, sudden storms, or poor visibility.
Injury from marine life or sharp objects in or around the water.
Equipment failure or breakage while in use.
Risk of cold water shock, hypothermia, and sun exposure.
Risk of injury when transporting, carrying, or handling equipment on land.

I understand that these risks can result in serious injury, illness, disability, or death, and I voluntarily accept full responsibility for my safety and actions.

2. Water Safety Acknowledgement

I confirm and accept the following responsibilities when using Surf Hire Direct equipment:

I have a basic swimming ability and feel confident in the water.
I understand the importance of checking local weather and tide forecasts before entering the water.
I will use the equipment only in designated, safe areas appropriate for my skill level at a lifeguarded beach.
I will avoid restricted zones, dangerous currents, and conditions unsuitable for my ability. (Indicated by a red flag on lifeguarded beaches).
I understand that Surf Hire Direct provides no lifeguard supervision, and I am solely responsible for my safety. I further understand that the safest place for me to use the equipment is at a lifeguarded beach in the designated zones.
I will not enter the water under the influence of alcohol, drugs, or any substance impairing my judgment.
I will wear all recommended safety equipment (such as leashes, buoyancy aids, and wetsuits), ensuring proper fit and condition before use.
I am responsible for ensuring all equipment is correctly used and stored during the hire period.

3. Release of Liability & Indemnification

I fully release Surf Hire Direct, its owners, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of injury, illness, disability, death, or damage to personal property resulting from my use of the hired equipment.
This waiver applies even if such injury, damage, or loss is caused, in whole or in part, by the negligence of Surf Hire Direct.
I agree to indemnify and hold harmless Surf Hire Direct from any claim brought against them related to my use or misuse of the equipment.

4. Loss, Damage & Equipment Care Policy

I accept full responsibility for all equipment provided under my hire agreement, from the time of delivery to the time of return collection by Surf Hire Direct.
I will not modify or alter the equipment in any way.
I will not sublet, lend, or allow others to use the equipment without the prior written consent of Surf Hire Direct.
I will use the equipment only for its intended purpose and in appropriate conditions.
I will rinse and clean equipment after use and store it safely when not in use.
If any equipment is lost, stolen, or damaged during the hire period (including but not limited to damage caused by misuse, impact, neglect, or exposure to inappropriate conditions), I agree to:
- Report the incident to Surf Hire Direct immediately.
- Pay repair or replacement costs as determined by Surf Hire Direct, up to the full retail value of the equipment.
- Authorise Surf Hire Direct to charge my provided payment method for such costs.
Surf Hire Direct will assess the condition of equipment upon return, and I accept that their assessment will be final.

Repair/Replacement Costs:

Adult Wetsuits: Up to £50
Childs Wetsuits: Up to £60
6ft Soft Surfboard: Up to £140
7ft Soft Surfboard: Up to £150
8ft Soft Surfboard: Up to £160
9ft Soft Surfboard: Up to £170
Surfboard leash: £15 (Replacement only)
42 inch Bodyboard: Up to £32
37 inch Bodyboard: Up to £30
Bodyboard Leash: £10 (Replacement only)

5. Identification, Delivery & Collection

I agree to present a valid driving licence upon delivery.
I consent to Surf Hire Direct making a secure record (following GDPR guidelines) of my identification details for security and anti-theft purposes.
Equipment will only be delivered to, and collected from, the agreed delivery address.
I will be present at the agreed time to accept delivery and return the equipment unless pre-agreed otherwise.
Failure to provide ID at delivery will result in immediate cancellation of the hire, and no refund will be provided.

6. Insurance

I understand that Surf Hire Direct does not provide personal accident, injury, or equipment insurance as part of the hire.
I accept full responsibility for ensuring I have adequate personal insurance if desired.
Any personal insurance I hold is secondary to this agreement, which requires me to pay for damage, loss, or theft directly.

7. Cancellations & Refunds

Cancellations made more than 1 Week prior to the hire start time may be eligible for a 50% refund, minus any reasonable administrative fees.
Cancellations made within 1 Week of the hire start date will not be eligible for a refund.
Refunds will not be issued for early return of equipment unless agreed in writing before the hire period starts.
Cancellations due to weather conditions (as confirmed by Surf Hire Direct) will not be eligible for refunds however Surf Hire Direct can re-schedule your booking.

8. Agreement to Terms

By proceeding with payment, I confirm that:

I have carefully read, understood, and agreed to all terms, conditions, and responsibilities set out in this document.
I accept all risks associated with the hire and use of the equipment.
I agree that this agreement is legally binding and enforceable.
I confirm I am over 18 years of age, or if under 18, a parent/guardian has accepted these terms on my behalf.
